Service scope
Kiwi Outreach provides software for contact management, campaign drafting, scheduling, delivery workflows, reply tracking, and team operations. The service is operated personally by Shrey Kumar Soni and Prince Khatri. The service is offered on a subscription basis and may also include onboarding, support, and beta API access for eligible plans.
By accessing the service, creating an account, requesting access, or purchasing a plan, you agree to these Terms and Conditions, our Privacy Policy, Cookies Notice, Acceptable Use Policy, Cancellation & Refund Policy, Data Processing Addendum, Security Overview, and Subprocessors Notice.
Eligibility and account responsibility
- You must be legally capable of entering into a binding contract.
- You are responsible for the accuracy of your account information, seat assignments, mailbox credentials, and outreach content.
- You must keep credentials confidential and promptly notify us of suspected unauthorized access.
Outreach responsibility
You are solely responsible for the recipients you contact, the legality of your outreach, the claims in your messages, and compliance with applicable marketing, anti-spam, privacy, telecom, and consumer laws in every geography where you operate.
- Do not send unlawful, deceptive, harassing, infringing, or misleading messages.
- Do not use purchased or unlawfully sourced lead lists.
- Honor unsubscribe, do-not-contact, suppression, and local consent requirements.
- Do not use the service to evade platform restrictions, mailbox provider rules, or sanctions/export controls.
Payments and subscription changes
Paid plans are billed in advance. Fees, taxes, and processor charges are due on the billing date shown at checkout. Payments are currently intended to be processed through Instamojo or another approved payment processor acting for the Service Operators.
Plan changes, downgrades, and suspensions may alter feature limits immediately or at the next billing cycle depending on the workflow selected at checkout.
No performance guarantee
We do not guarantee campaign outcomes, inbox placement, reply rates, fundraising success, sales conversions, or commercial performance. The service is an operational tool, not a promise of business result.
Suspension and termination
- We may suspend or terminate access for abuse, non-payment, fraud risk, policy violations, legal risk, or behavior that could harm the service, payment operations, mailbox reputation, or other users.
- We may preserve logs, support records, and billing records where required for compliance, dispute handling, or legitimate business purposes.
Liability and governing law
To the maximum extent permitted by law, the service is provided on an 'as available' basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Our aggregate liability for claims relating to the service is limited to the fees paid by you to Kiwi Outreach during the three months preceding the event giving rise to the claim.
These terms are intended to be interpreted under applicable Indian law, subject to any mandatory consumer protections that apply in your jurisdiction. Disputes are intended to be handled through the competent courts at Shahdol, subject to any rights that cannot lawfully be excluded.
